<p>The subject properties are two-storey, Main Street Commercial Row type buildings on Dundas Street West near Pacific Avenue within the Junction Phase I Heritage Conservation District Study Area. See attachment 1 for a location map.</p>

<p>The two properties recommended for inclusion on the City's Heritage Register have been researched and evaluated by staff using the criteria prescribed in Ontario Regulation 9/06 and meet one or more of the provincial criteria for determining cultural heritage value or interest and are believed to be of cultural heritage value or interest.</p>
<p> </p>
<p>On January 1, 2023, amendments to the Ontario Heritage Act (the Act) through the More Homes Built Faster Act, 2022 (Bill 23) came into effect. Under the Act, as amended, a municipal heritage register may include properties that have not been designated but Council believes to be of "cultural heritage value or interest", and that meet one or more of the provincial criteria for determining whether they are of cultural heritage value or interest. The Act now also limits listing to a period of two years.</p>
<p> </p>
<p>As of January 1, 2023, should a property be subject to an Official Plan Amendment, Zoning By-law Amendment and/or Draft Plan of Subdivision Application, properties must be listed on the heritage register prior to Part IV designation and before the occurrence of a prescribed event. A prescribed event is a point of time when the application for an Official Plan Amendment, Zoning By-law Amendment and/or Draft Plan of Subdivision Application has been deemed complete and the City Clerk provides notice of that complete application to the public in accordance with the Planning Act.</p>
<p> </p>
<p>The listing of non-designated properties on the municipal heritage register under the Act also extends interim protection from demolition and provides an opportunity for City Council to determine whether the property warrants conservation through designation under the Act should a development or demolition application be submitted.</p>
<p> </p>
<p>Properties on the Heritage Register will be conserved and maintained in accordance with the Official Plan Heritage Policies. Heritage Impact Assessments (HIA) are required for development applications that affect listed properties.</p>
<p> </p>
<p>As the Toronto Preservation Board and Toronto and East York Community Council are both meeting on May 7, and if Community Council adopts staff recommendations, the Toronto Preservation Board’s advice will transmit directly to Council. This will ensure City Council has the advice of the Toronto Preservation Board in making their decision to include the properties as identified in this report on the Heritage Register.</p> |

<p>In May and August 2022, the City received Official Plan Amendment, Site Plan Control and Zoning By-law Amendment applications related to the proposed redevelopment of the subject properties to permit a 31-storey mixed-use building atop a seven-storey podium, containing 492 new rental dwelling units (including 408 new affordable units) and 1,356 square metres of non-residential gross floor area. The proposal includes partial retention and restoration of the subject properties in-situ.</p>

<p>The proposed development is consistent with the existing policy framework and proposes an overall conservation strategy that conserves the heritage resources at the subject development site.</p>

<p>The owner has submitted an application to alter the designated heritage properties under Section 33 of the Ontario Heritage Act and this report recommends the application be approved subject to refinements to the alterations of the lower floors.</p> |

The applicant has worked with Transportation Services staff to revise their proposal to improve vehicle and pedestrian sightlines by lowering the solid masonry walls to 1.0m with open metal picket fencing surrounding the Whitney Avenue driveway. The fence and walls surrounding the site have also been modified to provide a minimum 1.0m clearance from existing utility poles and sign posts and 0.50m from the rear edge of the sidewalk.</p>

<p>Transportation Services has reviewed the application to construct and install encroachments within the public right-of-way at 135 Glen Road. The encroachments consist of concrete and metal iron fences, automated gates, stone/concrete/brick privacy walls and pillars, and a beech tree privacy hedge which is in contravention of City of Toronto Municipal Code Chapter 743, Streets and Sidewalks, Use Of. Specifically, the concrete and metal iron fences, automated gates and stone/concrete/brick privacy walls, pillars and beech tree privacy hedge do not meet the height restrictions required for an encroachment of a fence structure.</p>

<p>Although the concrete and metal iron fences, automated gates, stone/concrete/brick privacy walls and pillars, and beech tree privacy hedge are in contravention of the requirements under Code Chapter 743, staff is of the opinion that it will not have a negative impact on the public right-of-way. <p>I’ve been informed that park naming is not within the currently set scope of the established Community Advisory Committee and Indigenous Advisory Circle. Instead, residents have been directed to complete a Commemorative Property Naming Form which would be reviewed against the Commemorative Framework.</p>

<p>With the significant interest in the naming process, I believe that a more proactive process is needed to hear and balance the desires of the local community. In addition, I know that it is a priority to Ward 9 for the commitments made by the City of Toronto in the Reconciliation Action Plan to be fulfilled. This plan includes a commitment to “work with language speakers and Knowledge Carriers, and ensure that Indigenous language is given priority in the naming and renaming of City streets, parks and other City assets.”</p>

<p>The Toronto Fringe Festival is the most accessible arts event in the city, presenting 77 theatrical shows at 16 venues across the city from July 3-14, 2024. Fringe has premiered some of Canada's most successful productions including Kim's Convenience, My Mother's Lesbian Jewish Wiccan Wedding, 'Da Kink In My Hair, The Drowsy Chaperone, and Mump and Smoot. All Fringe Festivals in Canada are mandated to choose their participants by lottery and return 100% of the box office revenues to the artist in the festival, which has seen a return of over $6.5 million over the past three decades to artists from across the country. It is one of the longest-running City-supported events and has received municipal endorsement each year for over a decade.</p>

<p>Municipal Code Chapter 937-3 authorizes the General Manager of Transportation Services to temporarily close to vehicular traffic any portion of a road for a period of not more than four consecutive days for social, recreational, community, athletic or cinematographic purposes. This proposed closure will be in effect for more than 4 days and, therefore, requires Community Council approval. There will be no amplified noise outdoors after 11:00 p.m. The Toronto Fringe was granted the same street event closure permit in both July 2022 and July 2023, and received no noise or other complaints.</p> |

<p>At the June 27th, 2022, meeting of Toronto and East York Community Council, TE34.195 directed city staff to install traffic control signals at the Intersection of Heath Street West and Tweedsmuir Avenue/Lower Village Gate. The installation of this traffic control signal was a necessary intervention at a misaligned intersection where right-of-way and safe crossing for pedestrians was a consistent issue. </p>
<p> </p>
<p>Whereas the previous stop sign intervention at this intersection only required a 15-metre no-parking prohibition, the traffic control signal that was installed in December 2023 now requires a 30-metre no-parking prohibition. The installation of this traffic control signal has taken out approximately 61-metres of curb spaces that was previously licensed for on-street permit parking per 950-400 E (3) of the Toronto Municipal Code. The result has had a significant negative impact on residents who use Permit Parking Area 13K, an area that already has a constrained permit parking capacity. </p>
<p> </p>
<p>While the process to expand a permit parking area usually requires a petition, I firmly believe that this is not a feasible solution for the residents as there are several high-density residential buildings in the area.</p>
<p> </p>
<p>In order to ensure that the traffic safety intervention at Heath St W and Tweedsmuir Ave/Lower Village Gate can continue to serve the area while also addressing the capacity issue, I am asking for your support to waive the polling requirements. </p>
<p> </p>
<p>Staff can swiftly initiate the process to amend the boundary of Permit Area 13K and increase the number of permitted spaces by licensing limited sections of Lonsmount Drive and Tweedsmuir Avenue without the need for a petition and poll process. </p> |

<p>On May 2nd, 2024, my office was made aware that a parent and their child were struck by a motorist while crossing Davisville Avenue at a designated Pedestrian Crossover (PXO) at Acacia Road while walking to Davisville Public School. While we are heartened to hear that both victims are expected to make a full recovery, this incident has brought the safety of vulnerable road users to the front of everyone’s mind in the community.</p>

<p>Many local residents have reached out to my office since then, reporting that motorists not paying attention to the PXO is an all-too common occurrence and near-misses happen daily. After speaking with city staff, the principal of Davisville Public School, and many residents, I have heard that an immediate near-term solution is required and that the solution include the immediate placement of a crossing guard at this PXO. </p>

I visited the site with the business owners and Transportation Services earlier this year to initiate this. However due to this configuration only being confirmed recently, these businesses need to move quickly to install sidewalk or curbside cafes instead of the CaféTO installations they had in 2023. I am asking for your support to expedite these approvals and waive some restrictions, as a temporary measure during this construction. Supporting our small businesses through the Metrolinx construction is a logical step to take to keep our main streets vibrant during construction.</p>

<p>On Queen, Bonjour Brioche is immediately next to ongoing bridge, track and station construction. With that impacting CafeTO plans, they have also been caught up in trying to get a permit for their existing flankage patio, which lapsed during an ownership transfer.</p>
<p> </p>
<p>For this business, hanging on during significant construction, this patio is vital. Providing temporary relief to allow them to operate at least for this summer will help us support this East End institution through such a big challenge. As small businesses only start to recover from the pandemic impacts, providing flexibility and support to those now impacted by Metrolinx is a key way that the City can maintain our vibrancy.</p>
